This website is operated by Rabinowitz Photography (“we”, “us”, “our”). This Copyright Policy explains the rights in and to the creative works displayed on our website and store, and sets out the terms under which you may view, share, or request permission to use our content. By accessing or using our website, you agree to comply with this Policy, our Terms of Service, and our Privacy Policy.
SECTION 1 – OWNERSHIP OF CONTENT
All photographs, images, videos, text, designs, graphics, logos, product names, and other creative content made available on this website (collectively, the “Content”) are protected by the South African Copyright Act 98 of 1978 and international copyright conventions. Unless otherwise stated, the Content is the exclusive property of Rabinowitz Photography or its licensors. Copyright subsists automatically on creation.
Important: Our fine art photographs are limited-edition artworks. Any unauthorised copying, adaptation, or derivative artwork (including pencil, paint, digital, AI-assisted, or any other medium) is strictly prohibited.
SECTION 2 – PERMITTED PERSONAL USE
You may:

View the website and Content for personal, non-commercial purposes; and

Share public links to our pages on social media without downloading or altering the Content.
You may not reproduce, download, copy, screenshot, scrape, frame, hotlink, adapt, publish, distribute, or create derivative works from the Content without our prior written permission.
SECTION 3 – PROHIBITED USES (NON-EXHAUSTIVE)
Without limitation, you must not:

Reproduce or sell our photographs or any derivative works (e.g., drawings, paintings, prints, digital renders, NFTs, merchandise).

Remove or obscure watermarks, copyright notices, or metadata.

Train, fine-tune, or feed our images into any AI/ML system or dataset, or use them for image-to-image generation, style transfer, or similar purposes.

Hotlink our images or embed them in third-party sites or apps.

Use the Content in any manner that competes with our artworks, editions, or products.
SECTION 4 – LICENSING & PERMISSION REQUESTS
We welcome legitimate licensing for press, editorial, exhibitions, partnerships, and selected commercial projects.
To request permission, please email sales@rabinowitz-photography.com with:
- Your full name, company, and contact details;
- A link (URL) or clear description of the specific image(s) requested;
- Intended use (medium, territory, duration, distribution, circulation);
- Whether the use is commercial, editorial, or educational;
- Deadlines and budget (if applicable).
We will respond with availability, fees, and licence terms if your request is approved. No rights are granted unless and until you receive a written licence from us.
SECTION 5 – EDUCATIONAL & NON-PROFIT USE
Educational or non-profit use still requires written permission unless your use clearly falls within a statutory exception under South African law. Where permission is granted, we may require:

- No alteration or removal of watermarks;
- Use of web-resolution assets we provide; and
- Restrictions on duplication, copying, and redistribution.
SECTION 6 – USER-GENERATED CONTENT & SUBMISSIONS
If you tag or submit content to us (e.g., reviews, testimonials, photos in your space), you represent that you own the content or have rights to share it, and you grant us a non-exclusive, royalty-free licence to display and share it on our platforms for promotional purposes. This licence can be revoked by written notice to sales@rabinowitz-photography.com; we will act reasonably to remove future uses where feasible.
SECTION 7 – REPORTING INFRINGEMENT (NOTICE & TAKEDOWN)
If you believe our Content is being used or copied without permission, or if you are the rights holder of content that appears on our site without authorisation, please email sales@rabinowitz-photography.com with:
- Your full name and contact details;
- A description and link to the work claimed to be infringed;
- The URL(s) of the infringing material;
- A good-faith statement that the use is unauthorised; and
- Proof of rights (if you are reporting your own work).
We may remove or disable access to alleged infringing material while we assess the report. Where appropriate, we may notify the uploader/party concerned and provide an opportunity to respond.
SECTION 8 – ENFORCEMENT & REMEDIES
We actively enforce our rights. Unauthorised use may result in civil and/or criminal liability. Remedies include (without limitation) interdicts, damages, account of profits, and delivery up/destruction of infringing copies. We also reserve the right to seek retrospective licence fees and recovery of legal costs where permitted by law.
SECTION 9 – CREDITS & ATTRIBUTION
When a licence is granted, credit is mandatory unless expressly waived in writing:

For digital uses, the credit should be reasonably proximate to the image and/or included in alt text or captions.
SECTION 10 – GOVERNING LAW
This Policy is governed by and construed in accordance with the laws of South Africa. Any disputes arising in connection with this Policy or the Content shall be subject to the exclusive jurisdiction of the South African courts, without prejudice to any mandatory consumer protections under applicable law.
SECTION 11 – CHANGES TO THIS POLICY
We may update this Policy from time to time. Updates will be posted on this page with the “Last updated” date revised accordingly. Your continued use of the website after changes are posted constitutes acceptance of the updated Policy.
